PRIVACY POLICY
Investment advisers are required by law to inform their clients of their policies regarding the privacy of client information. We are bound by professional standards of confidentiality that are even more stringent than those required by law.
Federal law gives the customer the right to limit some but not all sharing of personal information. It also requires us to tell you how we collect, share, and protect your personal information.
This policy also covers how we handle information when you opt-in to receive SMS messages and other electronic communications from us.
TYPES OF NONPUBLIC PERSONAL INFORMATION (NPI) WE COLLECT
We collect nonpublic personal information about you that is either provided to us by you or obtained by us with your authorization. This can include but is not limited to your Social Security Number, Date of Birth, Banking Information, Financial Account Numbers and/or Balances, Sources of Income, and Credit Card Numbers or Information. When you are no longer our customer, we may continue to share your information only as described in this notice.
When you opt-in to receive SMS messages or electronic communications, we collect your phone number, consent to send SMS messages, your email address, your basic contact information, your messaging history, communication preferences and interaction data. All personally identifiable information is stored on technology platforms necessary to service client accounts.
PARTIES TO WHOM WE DISCLOSE INFORMATION
We do not sell your nonpublic personal information. We also do not disclose your nonpublic personal information to nonaffiliated third parties so that they may independently market their products or services to you.
We may disclose information to custodians, broker-dealers, technology providers, professional advisers, compliance consultants, recordkeepers, mailing or communication providers, and other service providers as reasonably necessary to provide services to you and operate our business. We may also disclose information at your direction or with your consent; to process transactions and maintain your accounts; to prevent fraud or unauthorized activity; to comply with applicable laws, regulations, subpoenas, court orders, or regulatory requests; or as otherwise permitted or required by law.
Service providers receiving personal information from us are expected to use the information only for the services they perform or as otherwise permitted by applicable law and to maintain appropriate protections for the information.
ADDITIONAL INFORMATION FOR CALIFORNIA CLIENTS
For California consumers, we will not disclose nonpublic personal information to a nonaffiliated third party unless you have provided any consent required by California law or the disclosure is otherwise permitted or required by law. Permitted disclosures may include disclosures necessary to process or service transactions, maintain accounts, protect against fraud, comply with legal or regulatory requirements, or provide services through entities performing functions on our behalf.
If we disclose nonpublic personal information to an affiliate in circumstances in which California law provides a right to restrict that disclosure, we will provide the required notice and a reasonable opportunity to exercise that right before making the disclosure.
PROTECTING CONFIDENTIALITY OF CURRENT AND FORMER CLIENT’S INFORMATION
To protect your personal information from unauthorized access and use, we use security measures that comply with federal law, including computer safeguards and secured files and building.
In accordance with Regulation S-P and other applicable SEC privacy and cybersecurity requirements, we maintain policies and procedures reasonably designed to safeguard customer records and information and to protect against unauthorized access to or use of such information. We also maintain an incident response program reasonably designed to assess, respond to, and recover from incidents involving unauthorized access to or use of customer information and, where required by applicable law, to provide notice to affected individuals.
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide services, and to satisfy applicable legal, regulatory, contractual, recordkeeping, dispute-resolution, and security requirements. When information is no longer required, we dispose of it using measures reasonably designed to protect against unauthorized access or use.
FEDERAL & STATE LAW ALLOWS YOU TO LIMIT SHARING – OPTING OUT
Federal law allows you the right to limit the sharing of your NPI by “opting-out” of the following: sharing for non-affiliates’ everyday business purposes – information about your creditworthiness; or sharing with affiliates or non-affiliates who use your information to market to you. State laws and individual companies may give you additional rights to limit sharing. Please notify us immediately if you choose to opt out of these types of sharing.
DEFINITIONS: Affiliates – companies related by common ownership or control. They can be financial and non-financial companies; Non-affiliates – companies not related by common ownership or control. They can be financial and non-financial companies; Joint marketing – a formal agreement between non-affiliated financial companies that together market financial products or services to you.
CALIFORNIA RESIDENTS
If you are a California resident, additional California privacy requirements may apply to information we collect about you. Nonpublic personal information collected in connection with our investment advisory services is generally governed by federal financial privacy law, including Regulation S-P and the Gramm-Leach-Bliley Act, and by the California Financial Information Privacy Act. Other personal information that is not subject to those financial privacy laws may be subject to the California Consumer Privacy Act, as amended, if we meet the applicable statutory requirements. This California section supplements the remainder of this Privacy Policy.
